To whom it may concern:
Samartha Deva failed to comply with the Longmont Athletic Club by-laws on freeze and termination policies.
This is incorrect, I have requested a freeze/status change per fax on 12/28/2001 in order to avoid paying for services I will not use for the next two months and, as far as I can see, I have complied with the instructions given to me when signing up for this service as well as with the wording in the By-Laws sent to me by LAC:
Therefore, a charge for the full membership fee for the next month by LAC was incorrect. My request for reversal of charges, and since this did not happen, a subsequent dispute with my credit card company was more than adequate.

From LAC's side an adequate response to my requests in form of fax, email and regular, registered mail was not given. "Other" options mentioned in a phone message by Stephen Baum on 01/08/2002 have never been communicated, despite my repeated requests for communication via email or regular mail, lacking the possibility to call by phone during the given time window (9-4, M-F) at that time (Jan/Feb 2002).

Instead, my credit card had repeatedly been charged as if nothing happened.

Many attempts were made to contact Samartha Deva in regards to his L.A.C account.

This is incorrect. I have received ONE phone call as voice mail and ONE email pertaining to this matter as well as one anonymous E-Mail. Two attempts (which I have promptly responded to) are not "many".

No other communication has been received from LAC. The complete email exchange is in this file.
Please note on the fax letters sent to the facility, no return phone numbers were ever included and the number we have on file has been disconnected.
This is incorrect. All faxes sent by me had my contact phone number in the header - please see this fax as example. All correspondence sent by regular mail had my LAC membership number - please see this letter as an example. The correct phone number is in LAC's file, please see a copy of the contract with my phone number from LAC's files sent to me by my credit card company here. My phone number was never out of service nor disconnected at any time. You may verify the presence of either phone number or membership number on every document originating from me here.

As a matter of fact, LAC's Stephen Beam left a message under this number on 01/08/2002 - how could it have been disconnected or unknown to LAC?

emails sent to samartha Deva, reminding him of our 30 day notice cancellation policy, at no time did he suggest he wanted to cancel his membership, only freeze it.
This is incorrect - An E-Mail from LAC to me with the contents described above does not exist! The only email received does not contain the information described and can be seen here. A request for status change has been submitted in writing via fax on 12/28/2001. Alternative options, announced verbally by LAC's Stephen Beam but never substantiated, could not be followed. Eventually, after the second unauthorized charge was posted against my credit card account, I send a letter by certified mail asking to end my membership after the requested suspension period. This letter was received by LAC, with the return receipt showing the signature of a "Vicky Felton".
Our freezing policy is available only for medical reasons and with doctors prescription.
This is incorrect, as far as I can see and contradicts the instructions I received from the person at LAC when I signed up for their services as well as information in the copy of the by-laws I received from LAC earlier.
His first fax (12/28/01) says if there is a problem with his request to call him on his disconnected number.
This is incorrect. The phone number on this fax is correct and has always been functional; please see a copy of all faxes sent here. This phone number was not disconnected - ever.
When notified about that via email, Samartha Devas reply was that this was our problem.
My quote is taken out of context, apparently to create a different impression. It has been claimed by LAC that there was a problem with printing my first fax. My fax log showed success and I stated, correctly, that the problem was on their side, which is a correct representation of the facts.

If the reverse charge goes through, the balance of $ 49.00 will be applied to his account and his account will be sent directly to collections.
